What documents do you need to sell a house?
To sell your home, it is essential to have a series of mandatory documents ready, which are necessary to ensure the regularity of the sale and to quickly reach the notarial deed.
- The documents are divided into:
- Titles of origin (which prove where the property comes from)
- Urban planning documents
- Cadastral documents (certifying the status and compliance of the property)
Having all the documentation in order avoids delays, blockages to the sale, and additional requests from the buyer or notary.
List of documents required to sell a house
Here is a checklist of the main documents to prepare before putting a property up for sale.
- Deed of origin: this is the document that proves how you acquired ownership of the property; if you do not have it, you can request it from the notary's office or the Revenue Agency - registry office
- Mortgage certificate: this is used to check whether the property is subject to mortgages, foreclosures, or other restrictions. It can be requested by the notary, real estate agency, or trusted technician
- Cadastral survey: this contains technical and identifying information about the property (sheet, parcel, sub-parcel, cadastral income, etc.); it is important that it is consistent with the actual state of the property
- Cadastral floor plan: this is the graphic representation of the house filed with the Land Registry. It must accurately reflect the state of the premises: if there are any discrepancies, they must be regularized before the sale
- Energy Performance Certificate (APE): required by law in order to sell a property; it must be drawn up by a qualified technician (engineer, architect, or surveyor) and contains: energy class, consumption, recommendations for improving efficiency
- Building permit: this serves to demonstrate that the property was built (and/or modified) with the correct municipal permits (building license, building concession, building permit, amnesties/pardons if applicable)
- Building regulations: these may be requested by the buyer or the notary to verify any restrictions or extraordinary expenses
- Mortgage contract: if the house is still subject to a mortgage, the seller must provide: updated position, remaining debt balance, any request for early repayment
- Lease agreement: if the property is occupied by a tenant, a copy of the existing registered contract must be provided
What to pay attention to when selling a house?
Although these are the main documents required for any sale, each property has a different history, so additional documents may be required depending on building restrictions, unresolved inheritance issues, common areas, or attached land.
Check with a notary or technician to see if there are any urban planning or cadastral irregularities that need to be resolved: small discrepancies can block the sale, so it is best to take action in good time.
